What is LPA receivership?

LPA receivership is a fixed-charge enforcement remedy under sections 101 and 109 of the Law of Property Act 1925. The lender appoints a Fixed Charge Receiver — typically a chartered surveyor — to take control of the secured property, collect rents, manage the asset and ultimately sell it to repay the debt. The receiver is the borrower's agent in law, which usually keeps the lender out of mortgagee-in-possession liability.

When should a lender appoint an LPA receiver instead of an administrator?

LPA receivership is property-specific and faster, cheaper and less invasive than administration. It is the right tool when the security is real estate, the loan is in default, and the lender wants control of the asset (rent, management, sale) without taking over the borrower's wider business. Administration is appropriate where the borrower's whole company needs rescuing or restructuring.

How quickly can you accept a receivership appointment?

Same day for straightforward residential and commercial assets, once the lender's deed of appointment, security review and indemnity are in order. Complex portfolios or mixed-use schemes typically mobilise within 48 hours.

What does an LPA receiver actually do?

Secure the property, change locks where vacant, manage tenancies and collect rent, instruct insurance and utilities in the receiver's name, deal with VAT and statutory returns, run a marketing and disposal process where required, and account to the lender throughout.

Who pays the receiver's fees?

The receiver's fees and expenses are paid out of rental income and ultimately the sale proceeds, in priority to repayment of the debt — they do not come out of the lender's pocket. Fees are agreed in the appointment documentation and disclosed to the borrower.

Is asset management an alternative to receivership?
